Abstract: Rechtsanwalt Prof. Dr. Dr. Klaus Ulsenheimer München Zusammenfassung Einleitend werden allgemeine Anmerkungen zum Arztstrafrecht in der Praxis gemacht. Es werden die wichtigsten Fehlerquellen aufgezeigt z. B. der Begriff des "Kunstfehlers" die individuelle Schuldprüfung Aufklärungsfehler fahrlässige Körperverletzung. Zur Kausalitätsproblematik in der Justizpraxis wird Stellung genommen und die Rolle des medizinischen Sachverständigen im Kunstfehlerprozeß wird erläutert. Abstract About the legal responsibilities of the physician regarding mistakes in treatment organization and information Introductory basic comments about the medical criminal law in the practice are given. The most important reasons for mistakes are demonstrated i.e. the term "professional blunder" the individual proof of guilt mistakes in informing the patient harming the patient by careless actions. The problem of causality in court is mentioned and the role of the expert witness in professional blunder trials is explained.
