Competence and indemnity in complementary medicine

Abstract: The article considers the liability of the cornplementary therapist in negligence compared with the liability of the referring doctor. The elements which have to be established in an action for negligence are discussed. The determination of the appropriate standards of care is considered. Vicarious liability of the employer is compared with direct liability. An example of a Potential action for negligence is taken to illustrate how the law would operate.
