Rehabilitation - eine Herausforderung an Gesetzgeber und Sozialverwaltung

Bertram Schulin Universität Konstanz Juristische Fakultät Zusammenfassung Das Rehabilitationsgeschehen hat sich von den Anfängen der Sozialgesetzgebung bis heute extrem und positiv gewandelt wenn man die derzeitige Sozialgesetzgebung Rechtsprechung wissenschaftliche Literatur sowie die große Anzahl von Institutionen betrachtet. Die anstehenden Aufgaben der Gegenwart und der Zukunft betreffen gleichermaßen den Gesetzgeber und die Sozialverwaltung. Aufgabe des Gesetzgebers ist es Lücken im Gesetz zu schließen und begriffliche Klarheit zu schaffen. Ein einfacheres und zugleich sozial gerechteres Rehabilitationsrecht ist in der Bundesrepublik Deutschland nicht denkbar u. a. wegen der hohen Erwartungen an Qualität und Quantität der sozialen Leistungen. Eines der wichtigsten Probleme besteht darin zu bestimmen was soziale Rehabilitation und wie ihr Verhältnis zu anderen Rehabilitationsbereichen ist sowie die soziale Rehabilitation als Ganzes in den Aufgabenkatalog der Sozialversicherung aufzunehmen. Die Selbstverwaltung ist aufgerufen die ihr aufgrund der geltenden Normen zustehenden Handlungsspielräume noch besser auszunutzen. Dazu zählt auch eine Forschungskompetenz die speziell in der Krankenversicherung durch § 217 SGB 5 eingeräumt wird. Die Sozialleistungsträger sind aufgerufen die Grundlagen für Maßnahmenstandards für die verschiedenen Behinderungsarten zu definieren um Effektivität und Effizienz der Rehabilitation zu gewährleisten. Eine permanente Aufgabe der Sozialleistungsträger ist die Organisation und Koordination der Rehabilitationsmaßnahmen im gegliederten Rehabilitationssystem. Hier hat die Bundesarbeitsgemeinschaft für Rehabilitation ein weites Tätigkeitsfeld. Eine ständige Herausforderung ist die sozialethische Dimension zu berücksichtigen nach der die Gesellschaft verpflichtet ist neue Erkenntnisse im Rahmen des Möglichen nutzbringend im Dienste der Rehabilitationsaufgabe zu verwerten. Auch die persönliche Hilfe in Form mitmenschlicher Zuwendung zu den Behinderten darf nicht vernachlässigt werden. Rehabilitation - A Challenge to Lawmaker and Social Administration In light of contemporary social legislation jurisdiction scientific publications as well as the great numbers of institutions and facilities the field of rehabilitation has undergone profound positive changes from the beginnings of social legislation till today. Lawmaker and social administration are equally concerned with the tasks at hand today and in the future. The legislator is responsible for closing legislational gaps and for creating definitional clarity. Inter alia because of the high expectations relative to quality and quantity of social services and benefits it is not possible in the Federal Republic of Germany to achieve greater simplicity and at the same time greater social equity of rehabilitation law. One of the main problems is to determine what exactly is comprised by "social rehabilitation" as well as its relationships with other areas of rehabilitation aside from integrating social rehabilitation in its entirety into the catalogue of tasks incumbent on the social insurance sector. The self-government bodies are called on to make even greater use of the rooms for action accorded under the applicable provisions. This includes the competence for undertaking research which in particular in the health insurance sector emanates from art. 217 SGB 5 (Social Code Book 5). The social protection administrations are called on to define the bases for rehabilitation programme standards relative to the various disability types in view of safeguarding rehabilitation effectiveness and efficiency. Organization and coordination of rehabilitation measures within the structured rehabilitation system are among the ongoing tasks of the social security administrations a field where Bundesarbeitsgemeinschaft für Rehabilitation the Federal Rehabilitation Council faces a broad range of functions. To have due regard to the social-ethical dimension that obligates Society to utilize new knowledge as far as possible for the benefit of rehabilitation is a constant challenge. The aspect of personal help of interpersonal empathy toward the disabled must not be neglected either.
