Ärztliche Haftung bei ambulantem Operieren

Abstract: Prof. Dr. Hans Friedrich Kienzle Kliniken der Stadt Köln Chirurgische Klinik Krankenhaus Holweide Zusammenfassung Durch das Gesundheitsstrukturgesetz vom 1. 1. 1993 sind im Krankenhaus teilweise auch in chirurgischen Praxen völlig neue Rahmenbedingungen geschaffen worden um das ambulante Operieren auszuweiten insbesondere aber auch bisher stationäre Leistungen in den ambulanten Bereich überzuführen. Zusätzlich zum grundsätzlichen Vertrag nach SGB V zum ambulanten Operieren kommt seit dem 13. 6. 1994 noch eine besondere Vereinbarung über Qualitätssicherungsmaßnahmen beim ambulanten Operieren gemäß Paragraph 14 des Vertrags nach Paragraph 115b Absatz 1 SGB V hinzu. Um qualitativ hochstehende Leistungen im ambulanten Bereich zu erbringen und den Standard stationären Operierens zu halten sind damit qualitative Mindestanforderungen vorgegeben. Grundsätzlich ist Haftung und Aufklärung beim ambulanten Operieren im Prinzip gleich dem des stationären Operierens. Sämtliche Details müssen jedoch prospektiv und intensiver bedacht besprochen und dokumentiert werden da der Patient vor dem Eingriff und nach dem Eingriff nicht unmittelbar zur Beobachtung und zur Besprechung zur Verfügung steht. Die präoperativen Konstellationen müssen sorgfältiger überprüft werden um dann auch operieren zu können und nicht einen geplanten Eingriff unter Umständen wegen mangelnder Befundkonstellation oder schlechter Organisation verschieben zu müssen. Für die Befundübernahme anderer Kollegen gilt der Vertrauensgrundsatz gleichwohl bleibt die letzte Haftung beim operierenden Chirurgen. Die postoperative Sicherungsaufklärung muß symptombezogen sein; das heißt man muß dem Patienten die Symptome einzelner postoperativer Erscheinungen und Komplikationen erklären damit er bei Eintritt einer solchen Komplikation rechtzeitig reagieren kann. Insgesamt ist die postoperative Sicherungsaufklärung außerordentlich wichtig: Schmerzen Blutung Thromboseprophylaxe Immobilisation Transportprobleme und dauernde Erreichbarkeit des Operateurs sowie postoperative Sprechstundenbesuche müssen geklärt und abgesprochen sein um dem Arzt vom geforderten Expertenstatus und dem gültigen medizinischen Standard gerecht zu werden und damit auch den juristischen Anforderungen der Haftung vollauf zu genügen. Abstract Medical liability for outpatient surgery Due to the structural reform of the public health service an Jan. 1 1993 totally new conditions are generated for the hospital and partially for the surgical practice to extend the outpatient surgery especially to transfer stationary tasks to the ambulant area. Additionally to the basic contract according to SGB V for ambulant surgery a special agreement about procedures for quality control in ambulant surgery according to sec. 14 of the contract regarding sec. 115b par. 1 SGB V has been added since June 13 1994. Minimal requirements of quality are demanded to achieve a high quality in the outpatient area and maintain the standards of the stationary surgery. However any detail has to be prospectively and more intensively considered discussed and documented since the patient will not be available for supervision or discussion before and alter surgery. The preoperative setting has to be checked carefully to avoid a situation where an elective surgery has to be postponed due to other pathologic findings or a faulty organization. The principle of trust may be applied when findings from other physicians are adopted but the final liability has the physician undertaking the surgery. The Information of the patient after surgery has to be adapted to the symptoms. Thus the symptoms of any problem or complication after surgery have to be explained to the patient that he can act properly if such problems occur. Actually the patient's information alter surgery is very important: pain bleeding prophylaxis of thrombosis immobilization transport problems and the availability of the surgeon at any time as well as a regular attendance during the consulting hours have to be clarified and discussed to maintain the demanded expert status of the physician and the valid medical standards as well as to meet the legal requirements for liability.
