Aufklärung bei begrenzter Verständnisfähigkeit

Beckmann) Würzburg Zusammenfassung Einschränkungen der Einwilligungsfähigkeit bei ärztlichen Eingriffen gibt es aus vielen Gründen nicht nur wegen psychiatrischer Erkrankungen. Psychiatrische Krankheit Geschäftsunfähigkeit Einwilligungsunfähigkeit haben zwar Überlappungsbereiche sind aber voneinander unabhängig und müssen getrennt für den einzelnen Patienten und für die jeweilige Situation beurteilt werden. Bei Einwilligungsunfähigen ist - abgesehen von akuten Notlagen - die Zustimmung eines eventuell zu bestellenden Pflegers einzuholen; sie ersetzt jedoch nicht den Versuch einer Aufklärung des Patienten. Zeitpunkt Art und Umfang der Aufklärung müssen dokumentiert werden; bei Einschränkungen der Willensfähigkeit sollte auch die Beurteilung ob der Patient einwilligungsfähig war oder nicht nachvollziehbar dokumentiert werden. Informed Consent of Patients with Restricted Competence: Many conditions can diminish the capability to informed consent to medical or surgical treatment - not only mental illness. Mental illness civil incompetence and incompetence to informed consent overlap to a certain extent but are independent of each other and have to be judged seperately for each individual and for each situation. A guardianship has to be established for those incapable to give informed consent and the guardian has to be informed and to consent to the operation. The consent of the guardian however does not replace the information of the patient. Time form and content of the information have to be documented thoroughly. Exceptions are only possible in cases of immediate urgency. If competence to informed consent is in doubt the documentation should also include a description of the mental status and the capability to understand the information. ab
