Abstract: Dr. Erich Steffen Vorsitzender Richter am Bundesgerichtshof Karlsruhe Zusammenfassung Solange ein Arzt in Weiterbildung noch nicht die Kenntnisse und Erfahrungen eines Facharztes hat muß ihn (bei chirurgischen Eingriffen) ein Facharzt begleiten. Fehlt diese Begleitung liegt die Beweislast daß ein Mißerfolg nicht auf den Defiziten an Facharztqualität beruht auf der Behandlungsseite. Gelingt dieser Beweis dann ist die Frage Facharzt oder Nichtfacharzt (auch für den BGH) "vom Tisch". Abstract The so-called specialist status from the view of the jurisdiction of the German court of justice As long as the resident as a physician in training does not have the knowledge of a specialist he has to be accompanied by a specialist (i.e. during surgical procedures). Is there a lack of such company the onus of proof that a failure is not due to the lack of specialist's quality is an the side of the therapist.
