Abstract: In the process of developing the Act an Drugs (1976) it was succeeded to establish the term "special directions in therapy" in the Act. Besides, the Bundestag (German Federal Parliament) determined that it is not the task of the legislation to favour one direction; that pluralism must be maintained. Homoeopathy, anthroposophy and phytotherapy are exemplarily specified. In the text of later amendments etc. the "exemplariness" disappears and the formulation gives the impression as if these three directions were the only special forms of therapy. This reduction of the term had fatal effects an handling the approval of drugs of the group 3 (organotherapeutics) and group 4 (microbial preparations) according to § 3 of the Act an Drugs. To have own commissions for approval and preparation had been denied. However, the number of directions in therapy is considerably larger since therapies of own character have developed in the various historical stages and cultural regions. But for the handling in health policy it is necessary to delimit directions in therapy of the experiential medicine from fantasy constructions. Therefore, for the incorporation into the legal frames some fundamental conditions as described in this article are indispensable.
